Presentation 1

Topic: How P&G lost their claim that Febreze® eliminates odors at the NAD and after appeal at the NARB:  Expert witness testimony by Daniel M Ennis PhD, President of the Institute for Perception, Richmond VA.

This presentation will address issues in advertising claim substantiation using, as an example, the refutation of P&G’s claim to eliminate odors using Febreze.  The critical issues in the case involved ecological validity, consumer relevance, testing bias, the wrong metric and post hoc bias.  Advertising claims support is an important input to innovation management.  Unlike typical market research projects, Claims Support has special requirements.  The research is typically highly focused, often involving a single question posed to a carefully selected population of consumers who are anticipated to be persuaded by the advertising message.  They may be current product users, but also may be potential users, and market share brand representation may be important.  The level of expert scrutiny of the experimental design, analysis, interpretation and communication of the results is usually extreme, often involving leading experts in all aspects of the substantiation and communication.       

Febreze is a registered trademark of the Procter and Gamble Company.

Speaker Bio:

Dr. Daniel M. Ennis is a founder and President of The Institute for Perception. He has decades of experience working on theory and applications in the behavioral sciences and has published over 100 peer-reviewed papers and technical reports. He is regularly engaged as an expert in false advertising cases.  He holds doctorates in Food Science (PhD) and in Mathematical & Statistical Psychology (DSc).  In 2021 he was awarded a DSc from the National University of Ireland for his contributions to the quantitative behavioral sciences.  He is a Professional Statistician accredited by the American Statistical Association. He was the first to show that humans possess a transducer in the Chemical Senses.  In 2001 he solved the degeneracy problem in multidimensional unfolding, an issue that had been unresolved for 50 years.  Danny is a recipient of the Sensory and Consumer Sciences Achievement Award from The Institute of Food Technologists and also the ASTM David R. Peryam Award in recognition of “outstanding contributions to the field of basic and applied sensory science.”

Presentation 2 – Seven Deadly Sins of Data Analytics by Jay Arthur

There are billions, if not trillions, of dollars in annual savings waiting to be found in the United States. Often, data analysis fails because of the 7 Deadly Sins: Pride, Gluttony, Wrath, Lust, Greed, Envy and Sloth. Over the last 35 years, I’ve been stymied by each one. Let’s look at the sins, figure out ways around them and start analyzing data to save time, save money and save lives.

Speaker Bio:

Jay Arthur teaches people how to Turn Data Into Dollars® using Microsoft Excel and the Magnificent Seven Tools of Lean Six Sigma.  Jay helped one healthcare system reduce denied claims by $5 million per year and rejected claims by $24 million.  Jay is the author of Lean Six Sigma Demystified (2nd), Lean Six Sigma for Hospitals (2nd), and the QI Macros SPC Software for Excel—a software package that automates all of the charts, graphs, and documents required for quality improvement. Jay holds a BS in Systems Engineering from the University of Arizona.
