  • 1.  Question about RoHS 1 vs. RoHS 3

Hi all, I'm wondering if anyone can help me here.

If a company provides a Cert of RoHS Compliance that says "EU RoHS status is declared per Directive 2011/65/EU and its subsequent amendments," does this imply adherence to latest RoHS 3 EU 2015/863? I feel like I'm going crazy asking for certs from vendors and not getting what I need.

In other words, are RoHS 2 and RoHS 3 considered amendments to RoHS Directive 2011/65/EU, or are they something entirely different?

    thanks for your help!

Based on https://www.rohsguide.com/, it seems that RoHS 2 and 3 would both be considered those subsequent amendments to RoHS.

I refer to two items in there:

    1) "RoHS 2 also added Categories 8 and 9, and has additional compliance recordkeeping requirements." So, with this being Directive 2011/65/EU, it is an amendment to RoHS 2002/95/EC

    2) "RoHS 3 adds four additional restricted substances (phthalates) to the list of six." So with this being Directive 2015/863, it builds upon the previous two, and in an additional amendment.

Based on your original question as stated, if a company provides a certificate that explicitly states, "EU RoHS status is declared per Directive 2011/65/EU and its subsequent amendments" and the certification is dated after 22 July 2019, I'd say it is compliant.
